01 Acceptance of these terms

These Terms of Service (“Terms”) govern your use of spearn.ca and the tools offered on it (the “Service”), operated by Spearn (“Spearn,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

02 What Spearn is — and isn’t

Spearn is a free, informational tool that compares Canadian credit cards using the spending figures you enter and publicly available information about each card. It is intended to help you explore options.

Spearn is not a bank, lender, broker, or financial advisor, and nothing on the Service is financial, tax, credit, or legal advice. We do not offer credit or make lending decisions. Always consult a qualified professional and the card issuer before making financial decisions.

03 Estimates & accuracy

All rewards values, rates, fees, perks, and rankings shown by Spearn are estimates. They are calculated from the numbers you provide and from card details that can change at any time and may contain errors or become out of date.

Your actual results will depend on your real spending, your eligibility, and each issuer’s current terms. Always verify the current rates, fees, and conditions directly with the card issuer before applying. We do not guarantee that any information on the Service is accurate, complete, or current.

04 No guarantee of approval or outcomes

Spearn does not guarantee that you will be approved for any card, that you will receive any particular rewards or benefits, or that a card ranked highly for you is the best choice for your circumstances. Approval decisions, rates, and terms are made solely by the card issuers. All decisions you make based on the Service are your own responsibility.

05 Affiliate relationships

Some links on Spearn are affiliate links. Spearn may earn a commission if you are approved for a card after using one of our links, at no additional cost to you. This does not influence our rankings, which are generated by our engine from your inputs and publicly available card data. See our Privacy Policy for how information is handled.

06 Acceptable use

You agree to use the Service only for lawful, personal, non-commercial purposes. You will not attempt to disrupt, reverse-engineer, scrape at scale, overload, or misuse the Service, and you will not use it in any way that infringes the rights of others or violates applicable law.

07 Intellectual property

The Spearn name, logo, site design, text, and the comparison engine are owned by Spearn or its licensors and are protected by applicable intellectual-property laws. You may view and use the Service for your personal use, but you may not copy, redistribute, or create derivative works from it without our permission.

08 Third-party websites

The Service links to third-party websites, including bank and issuer pages. We do not control and are not responsible for the content, products, terms, or privacy practices of those sites. Accessing them is at your own risk and subject to their terms.

09 Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10 Limitation of liability

To the fullest extent permitted by applicable law, Spearn and the people who work on it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, or data, arising out of or related to your use of (or inability to use) the Service or your reliance on any information it provides — even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

11 Changes to the Service and these Terms

We may modify, suspend, or discontinue the Service, and we may update these Terms, at any time. When we update the Terms, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

12 Governing law

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict-of-laws principles. You agree that the courts located in Quebec will have jurisdiction over any dispute arising from these Terms or your use of the Service, subject to any mandatory consumer-protection rights you have where you live.
